אחרי שמספר ח״כים במפלגה התייחסו לפרשה (לא התרשמתי במיוחד) הרגשתי צורך לפרסם את ההתייחסות המדודה והאינטליגנטית של הילל בן ששון ממכון מולד לנושא שפורסמה לאחרונה בפייסבוק. הילל יודע על מה הוא כותב כי הוא…זו היא ההתייחסות הטובה ביותר לנושא שקראתי עד עכשיו – תשפטו אתם:

כמי שמכיר מקרוב את העשיה המודיעינית של 8200 למול הפלסטינים, אני רוצה להתייחס למה שבעיני הוא הטענה המהותית שבה אנחנו צריכים להתמקד:

לאורך השנים היתה קיימת חלוקת סמכויות ברורה ביחס לאיסוף מודיעין – הצבא, ובתוכו 8200, אחראי על איסוף מודיעין למול מדינות אוייב, ואילו שירות הבטחון הכללי אחראי על איסוף מודיעין למול איומים בתוך מדינת ישראל, כולל איסוף מודיעין על אזרחי ישראל עצמם (מימין ומשמאל). הנחת היסוד שעומדת מאחורי החלוקה הזו מבחינה בין אזרחי המדינה שהינם חלק מן הריבון הישראלי, ועל כן זכאים להגנות רבות בחוק הישראל (ובתוך כך גם להגנות מפני חדירה סמויה לפרטיותם), לבין גורמי לחימה ואזרחים במדינות אוייב שאינם נהנים מאותם הגנות.

אני מאמין שמעטים יחלקו על ההגיון במנדט של 8200 לאסוף מודיעין, ואפילו מודיעין פולשני, על מנת להגן על הגבולות המוסכמים של המדינה. אותן ההצדקות שמאפשרות לחיילי החי'ר והשריון להגן על גבולות המדינה תופסות גם ביחס לחיילי 8200 הערוכים למול סוריה, לבנון, איראן ועיראק. אני מאמין שגם מעטים יחלקו על ההנחה שחיילים צעירים בשירות חובה אינם אמורים לקחת חלק באיסוף מודיעין על אזרחי ישראל. אסור שפעולה כזו, שנמצאת בתחום הקיצון של זכות המדינה להגן על בטחונה ושכוללת פגיעה בוטה כל כך בחרויות של אזרחים-אחים תהיה נתונה בידי הצבא, וטוב שהשב"כ, ולא אמ"ן, מופקד על המשימות הללו.

כאן אנחנו מגיעים למערך שמופקד ב-8200 על איסוף מידע בגזרה הפלסטינית. הגזרה הזו הוקמה ב-8200 בימי תהליך אוסלו, כשהיה לכולם ברור שאוטוטו יש כאן מדינה חדשה שלמולה יש להיערך מודיעינית באותו האופן שבו הצבא ערוך למול מדינות שכנות אחרות. בעיני, זו היתה היערכות מוצדקת, מבלי להתייחס לפעולות כאלה או אחרת, כמו המעורבות של אספני מידע בפעולות סיכול שבהן ישנה סבירות גבוהה להרג לא מידתי של חפים מפשע.

אבל יש כאן אבל רציני. כשני עשורים לאחר הקמת מערך האיסוף המטפל בפלסטינים, הסטטוס קוו של הכיבוש נמשך – פלסטין איננה מדינה, אך תושביה גם אינם אזרחי ישראל. זהו תחום אפור, והאפור הזה לא רק מסוכן אלא גם מייצר מצבים שחיילים בצבא ההגנה לישראל אינם אמורים להתמודד איתם. מכתב הסרבנות שהתפרסם בסוף השבוע הוא כתובת נוספת על קיר הסטטוס קוו המדיני המעופש של מדינת ישראל.

תתכבד הנהגת המדינה ותחליט – סיפוח השטחים והעברת הסמכות המודיעינית לידי השב"כ, או פתרון של שתי מדינות והשארת הסמכות המודיעינית בידי אמ"ן. עד אז, חיילי 8200 שעוסקים בפלסטינים אינם שונים מן החייל שעומד במחסום – אלו ואלו נשלחו על ידי הנהגה רופסת לעסוק בפעילות שמעולם לא נועדה לאנשים בגילם ובמצבם. כל עוד הצעירים האלו שבויים בידי הנהגה רופסת שאינה מצליחה לקבל שום החלטה, הסירוב הבא הוא רק עניין של זמן, בין אם יהיו אלה תומכי הסיפוח שמקדמים את קץ הציונות ובין אם יהיו אלה מתנגדי הכיבוש שחרדים לגורלנו כחברה וכאומה.

After some MKs in the Labor party have taken positions on the scandal (and I wasn't impressed, to say the least) I felt the need to publish the very thoughtful and intelligent position published on facebook by Hillel Ben Sasson from the Molad Institute. Hillel knows what he's talking about:

As somebody who knows the intelligence work performed by 8200 vis-a-vis the Palestinians, I would like to relate to what I think is the central issue to which we should focus on:

For many years there was a clear separation of powers with regard to intelligence collection – the military and in it, unit 8200, was responsible for intelligence collection vis-a-vis enemy countries and the Israel Security Agency (Shabak) was responsible for the collection of intelligence within the State of Israel, including collection of intelligence on Israeli citizens (from the right and left). The basic assumption behind this separation of powers was that Israeli citizens are part of Israeli sovereignty and are therefore entitled to all legal protections afforded by Israeli law (including protection from covert invasions of privacy) whereas combatants and citizens from enemy countries are not afforded the same protection.

I believe that only a few will argue the logic of the mandate of unit 8200 to collect intelligence, even invasively, in order to protect and defend the agreed upon borders of the State of Israel. The same legitimizations that permit infantry and tank soldiers to protect and defend the borders of the state are relevant, just the same for soldiers serving in unit 8200 vis-a-vis Syria, Lebanon, Iran and Iraq. I also believe that few will argue the assumption that young soldiers in compulsory service should not partake in collection of intelligence on Israeli citizens. It should be forbidden that such an operational activity which is on the outer fringes of the right of the state to protect itself, activities which include flagrant violations of citizens rights, should be run by the military and it is only fair that the ISA (Shabak) and not Military Intelligence (AMAN) is empowered to perform these tasks.

And here we come to the division in unit 8200 that is collecting information vis-a-vis the Palestinians. This division was created within unit 8200 in the wake of the Oslo process  when it was clear to everyone that shortly, any day, a new Palestinian entity/state would come into being and would have to be dealt with intelligence-wise, just like the military deals with all the other countries. At the time, this was the correct arrangement without going into details regarding the involvement of the intelligence collectors in targeted killings with potential for the disporportional killing of innocent bystanders.

But and this is a serious but, twenty years after the Palestinian division was set up in unit 8200, the status-quo of the occupation is still maintained. Palestine is not a state and its inhabitants are not citizens of Israel. This is a grey area and grey isn't only dangerous but also creates situations that soldiers in the IDF are not supposed to deal with. The letter of the conscientious objectors which was published a few weeks ago is another writing on the wall of an occupation long overdue, still maintained by the State of Israel.

The leadership of the State must decide – annexation of the territories and transfer of the intelligence collection activities to the ISA (Shabak), or, a 2 state solution and leaving the intelligence authority in the hands of MI (AMAN). Until then, the soldiers of unit 8200 which deal with Palestinians are no different from infantry soldiers manning a roadblock in the territories – both were sent by a weak leadership to perform tasks that were never to be dealt with by people their age and their status. As long as these youngsters are captives of a weak leadership that is unable to reach any decision, the next conscientious objection is only a matter of time, if it will be by those supporting annexation to advance the end of Zionism or those who object to the occupation who are concerned about our future as a society and a people.
